2.1 Account Information (via Clerk)

When you create an account, Clerk collects:

  • Email address
  • Name (first and last)
  • Authentication credentials
  • Profile information

2.2 Waitlist Subscriber Data

When someone joins a waitlist you create, we collect:

  • Email address
  • Name (if provided)
  • IP address (for analytics and spam prevention)
  • User agent (browser information)
  • Country/location (derived from IP address)
  • Referral source (UTM parameters, referring URLs)
  • Referral code (for tracking viral referrals)

2.3 Analytics Data

We automatically collect:

  • Signup timestamps and positions
  • Referral engagement metrics (clicks, conversions)
  • Email engagement (opens, clicks - if tracked)
  • Waitlist growth rates and viral coefficients
  • Traffic sources and campaign parameters

2.4 Payment Information (via Clerk)

Payment processing is handled by Clerk's B2C billing system. We do not store your credit card details. Clerk collects and processes payment information according to their privacy policy.

3. How We Use Your Information

We use the collected information to:

  • Provide the Service: Create and manage waitlists, send emails, generate analytics
  • AI Content Generation: Use your product information to generate marketing content via Google Gemini AI
  • Email Communications: Send automated email sequences to waitlist subscribers via Resend
  • Analytics: Track signup trends, referral performance, and campaign effectiveness
  • Spam Prevention: Use reCAPTCHA v3 and rate limiting to prevent abuse
  • Billing: Process subscription payments through Clerk
  • Support: Respond to your inquiries and provide customer service
  • Improvements: Analyze usage patterns to improve our platform

PostgreSQL Database (Hosted)

All data is stored securely in encrypted PostgreSQL databases with regular backups.

5. Data Storage & Security

We implement industry-standard security measures:

  • Encryption: Data is encrypted in transit (TLS) and at rest (AES-256)
  • Database Security: PostgreSQL with Prisma ORM, secure connection strings
  • Authentication: Secure authentication via Clerk (OAuth2, JWT)
  • Rate Limiting: Protection against brute force and spam attacks
  • reCAPTCHA: Google reCAPTCHA v3 on public forms
  • Regular Backups: Automated database backups

However, no method of transmission over the internet is 100% secure. We cannot guarantee absolute security.

6. Data Retention

Account Data

Retained as long as your account is active. Deleted when you delete your account.

Waitlist Subscriber Data

Retained as long as the waitlist exists. When you delete a waitlist, subscriber data is permanently deleted.

Analytics Data

Aggregated analytics are retained for historical reporting but anonymized after 90 days.

Free Plan Limitations

Free users see up to 100 subscribers, but all subscriber data is stored. When you upgrade, full visibility is restored.

7. Your Rights

You have the right to:

  • Access: Request a copy of your personal data
  • Rectification: Correct inaccurate or incomplete data
  • Deletion: Request deletion of your account and data
  • Data Portability: Export your waitlist data (CSV/JSON)
  • Withdrawal of Consent: Opt-out of email communications
  • Object: Object to processing of your data

8. Cookies & Tracking

We use minimal cookies and tracking:

  • Authentication Cookies: Clerk session cookies (required)
  • reCAPTCHA Cookies: Google reCAPTCHA v3 cookies
  • Analytics: Basic traffic source tracking (UTM parameters)

We do not use third-party advertising cookies or sell your data to advertisers.

9. Children's Privacy

HypeQ is not intended for users under 13 years of age. We do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, please contact us immediately.

10. International Data Transfers

Your data may be transferred to and processed in countries outside your country of residence. We ensure appropriate safeguards are in place to protect your data in accordance with this Privacy Policy and applicable laws.

11. Your Responsibilities (For Waitlist Creators)

If you create waitlists and collect subscriber data, you are responsible for:

  • Complying with applicable privacy laws (GDPR, CCPA, CAN-SPAM, etc.)
  • Providing clear privacy notices to your subscribers
  • Obtaining proper consent for email communications
  • Honoring unsubscribe requests
  • Protecting your subscribers' data

You act as a data controller for your waitlist subscribers. HypeQ acts as a data processor.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We'll notify you of significant changes via email or through the platform. The "Last updated" date at the top indicates when changes were made.
