By accessing and using HypeQ, you accept and agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our service.
2. Service Description
HypeQ is an AI-powered waitlist platform that helps you:
- Create and manage viral waitlists for your products
- Generate marketing content using Google Gemini AI
- Build referral campaigns with tracking and analytics
- Send automated email sequences to subscribers
- Track signups and engagement metrics
3. User Accounts
Account authentication is handled by Clerk. You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4. Plans & Billing
We offer two plan types:
Free Plan
- 1 waitlist
- Up to 100 visible subscribers (all data is stored but visibility limited)
- Basic features and analytics
Premium Plan
- Unlimited waitlists
- Unlimited visible subscribers
- All advanced features including AI LaunchKit
Billing is processed through Clerk's B2C billing system. By subscribing:
- You authorize recurring charges to your payment method
- You can cancel your subscription at any time
- Upon cancellation, you'll be downgraded to the Free plan
- All your data is retained when downgrading (visibility may be limited)
5. Acceptable Use
You agree NOT to:
- Use the service for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Send spam or unsolicited communications through our email system
- Attempt to circumvent rate limits or security measures
- Use disposable email addresses to artificially inflate waitlist numbers
- Scrape or harvest data from other users' waitlists
- Interfere with or disrupt the service or servers
6. AI-Generated Content
HypeQ uses Google Gemini AI to generate marketing content. You acknowledge that:
- AI-generated content may require review and editing before use
- You are responsible for the content you publish from HypeQ
- We do not guarantee the accuracy or effectiveness of AI-generated content
- You retain ownership of content generated for your campaigns
7. Email Services
Email delivery is powered by Resend. By using our email features:
- You must comply with anti-spam laws (CAN-SPAM, GDPR, etc.)
- You must only email people who have explicitly signed up to your waitlist
- Recipients must have a clear way to unsubscribe
- We may suspend email privileges if abuse is detected
8. Data & Privacy
Your use of HypeQ is also governed by our Privacy Policy. Key points:
- You own the data you collect through your waitlists
- We store subscriber information securely in our PostgreSQL database
- We track basic analytics (IP addresses, countries, referral sources)
- You are responsible for complying with privacy laws for your subscribers
9. Rate Limiting & Security
To protect our service and prevent abuse, we implement:
- Rate limiting on public signup endpoints (10 requests/minute)
- Rate limiting on AI generation (3 requests/minute)
- Google reCAPTCHA v3 on public waitlist forms
- Automated spam detection
Violations may result in temporary or permanent account suspension.
10. Intellectual Property
Your Content: You retain all rights to the content you create and collect through HypeQ.
Our Platform: HypeQ's codebase, design, and branding are proprietary. You may not copy, modify, or reverse engineer our platform.
11. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. We may:
- Perform scheduled maintenance (with advance notice when possible)
- Experience temporary outages
- Update or modify features
We are not liable for any losses resulting from service downtime.
12. Termination
We may terminate or suspend your account if you:
- Violate these Terms & Conditions
- Engage in fraudulent or abusive behavior
- Fail to pay for premium services
You may delete your account at any time. Upon deletion, your data will be permanently removed from our systems.
13. Disclaimers
HypeQ is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:
- That your waitlist will achieve specific signup numbers
- That AI-generated content will produce desired results
- That the service will be error-free or secure
- That email delivery will be 100% successful
14. Limitation of Liability
To the maximum extent permitted by law, HypeQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
15. Changes to Terms
We may update these Terms & Conditions from time to time. We'll notify you of significant changes via email or through the platform. Continued use of HypeQ after changes constitutes acceptance of the new terms.
